The firm has experience in litigation of insurance coverage, insurance contract interpretation, and conflict of interest issues regarding insurance reservation of rights with the insured. The firm acts as independent counsel for the insured in its dealings with counsel appointed by the insurance carrier to better insure full observance of the policy by the insurer. The firm pursues claims for insurance coverage for defense and indemnity involving commercial general liability insurance (CGL) policies and other types of insurance policies.
The firm negotiated on behalf of a major east coast bank, against its insurance carriers, to enforce the carrier's obligation to defend pending litigation against the bank, and to settle all claims at the exclusive expense of the insurance carriers. All carriers involved disputed coverage for the claim or defense of the claim. Lead counsel: Steven M. Harris and Michael D. Davis.
